To play with our modification a licensed version of Battlefield™3 is required.

However the master server / modification itself is agnostic to the DLCs. This means (because the DLCs don't have an own license file) we can't check a legit existance of DLC files.

If you have the files you can play with them. If you don't have them, you can't.
